These Terms & Conditions explain how purchases, shipping, returns, and other practical matters are handled when you buy artwork through jkesin.com.
They’re designed to be clear, fair, and transparent, so you know exactly what to expect.

In case of any discrepancy, the English version of these Terms & Conditions prevails. Translations are automated and provided for convenience only.

1. Introduction

These Terms & Conditions govern all sales, enquiries, and use of the website jkesin.com.

Artworks are created by the artist J. Kesín and shipped from Spain on behalf of the above company.

By purchasing artwork or using this website, you agree to these Terms & Conditions.


2. Products and Availability

2.1 All artworks listed on jkesin.com are original works.
2.2 Availability is not guaranteed until confirmed by email.
2.3 Colours displayed on screens may differ slightly from the physical artwork.
2.4 Dimensions, materials, and descriptions are provided as accurately as possible.


3. Prices and Payment

3.1 All prices are shown in EUR unless otherwise stated.
3.2 Prices do not include shipping costs, which will be quoted during the enquiry process.
3.3 Payment is accepted via:
• Bank transfer
• Stripe (secure card payment) — available soon

3.4 Artwork remains the property of the seller until full payment has been received and cleared.
3.5 Orders may be cancelled by the seller if payment is not received within the stated timeframe.


4. Shipping

4.1 Artworks are shipped from Spain using UPS, DHL, or comparable international couriers.
4.2 Estimated delivery times will be provided during the ordering process, depending on destination and courier.
4.3 Buyers are responsible for all customs fees, import duties, or taxes applicable in their country.
4.4 Deliveries require a signature unless otherwise agreed in writing.


5. Transit Damage

If your artwork arrives damaged, you must notify us within 48 hours of delivery.

Please include clear photographs of:

• the damaged area
• all sides of the packaging (interior and exterior)
• the shipping box
• the shipping label

Additional evidence requested must be provided within 4 days of delivery.

This information is required to submit a courier damage claim.
Damage reported outside these deadlines may not be eligible for compensation.

After reviewing the case, we will offer an appropriate resolution, which may include:

• a full refund (for substantial damage),
• a partial refund,
• repair or restoration, or
• a replacement (where applicable)

If a return is required for a confirmed transit-damage claim, we will cover the return shipping costs.


6. Voluntary Returns (Change of Mind)

As a courtesy, we offer a 7-day voluntary return window from the date of delivery.

If you wish to return an artwork for any reason other than transit damage:

6.1 You must contact us within 7 days of delivery.
6.2 The artwork must be returned:
• in its original condition, and
• in its original packaging, or packaging providing equivalent protection.

6.3 Return shipping and return insurance are the buyer’s responsibility.
6.4 Refunds are issued once the artwork has been received and inspected.
6.5 Original shipping charges are non-refundable.

6.6 Refunds cannot be issued for artworks that return damaged.

This voluntary return policy does not affect your statutory rights.


7. Cancellations

7.1 Orders may be cancelled before dispatch with no penalty.
7.2 After dispatch, cancellations are treated as voluntary returns (Section 6).


8. Ownership, Copyright & Reproduction Rights

8.1 The buyer owns the physical artwork once payment is completed.
8.2 The artist retains all copyright and reproduction rights.
8.3 Artworks may not be copied, reproduced, or commercially used without written permission.


9. Liability

9.1 We are not liable for courier delays, customs delays, force majeure events, or circumstances beyond our control.

9.2 Once the artwork has been delivered and accepted, we are not responsible for any damage, loss, or deterioration that occurs thereafter.

9.3 Nothing in these Terms limits any statutory rights that cannot be excluded by law.

11. Governing Law

These Terms & Conditions are governed by the laws of England & Wales.
Any disputes shall be resolved exclusively in UK courts.
